TERMS & CONDITIONS
Terms & Conditions for Participation:
1.You confirm and undertake that You are over 18 (eighteen) years of age and that You hereby are voluntarily taking part in this Campaign, and You hereby accept the terms and conditions of the Campaign fully and unconditionally.
2.You grant PUMA INDIA Your consent to use Your personal information (as may be required by PUMA INDIA) solely for the purpose of the Campaign. PUMA INDIA shall have a right to share Your Personal Information with a third party for all purposes under these Terms & Conditions for the purpose of payment and for any other business for the purpose of fulfilling all objectives of its Campaign.
3.You hereby agree that PUMA INDIA may in its absolute and sole discretion curtail or extend the Campaign Duration as it deems necessary without any liability whatsoever.
4.You hereby agree, acknowledge You that have all the requisite permissions and consents from the relevant parties and on the basis of such You hereby authorise PUMA INDIA to use any/ all images/ videos that You may post/ upload on Your own social media Handle (X) . You shall not hold PUMA INDIA liable in case of a breach by You with regard to the said rules and regulations of the relevant authorities, infringement of third party intellectual property rights and You shall further indemnify PUMA INDIA against any claim/loss accrued due to the unauthorized use of the images, videos, information and/or photographs uploaded by You on X through Your own X handle for the purpose of the Campaign.
5.You agree and understand that this Campaign is being conducted by PUMA INDIA and shall also include its affiliates, subsidiaries third parties and successors for all the purposes in relation to the Campaign.
6.PUMA INDIA reserves its right to replace the winner if the winner is disqualified or fails to fulfil the requirements of the Campaign.
7.You hereby understand and agree that You shall not be eligible for participate in the Campaign in the event You fail to:
a. follow the rules of the Campaign;
b. have any criminal record;
c. fail to comply with any applicable laws,
d. make any offensive posts including but not limited to uploading any content (picture/text/any other content) of any kind that contain expressions of hate, abuse, offensive images or conduct, obscenity, pornography, is sexually explicit or against any religious sentiments or against any caste, creed or race or any material, which is offensive to women or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with any rules and regulations of the relevant authority, these Terms and Conditions or the Advertising Code of the Advertising Standards Council of India.
e. Upload any content which in the reasonable opinion of PUMA, is obscene, offending or hurtful.
f. You understand that only if meet the criteria as mentioned above and are otherwise compliant with these Terms and Conditions, You shall qualify for the Campaign. The decision of PUMA INDIA with regard to validity of Your entry shall be final and PUMA shall not entertain any claim or communication with respect to that entry by You.
8.By participating in the Campaign, You hereby agree to all the terms and conditions stated above and authorize PUMA INDIA to use in any manner whatsoever, Your posts uploaded on X through Your own handle for the purpose of the Campaign, Your name, Your photographs, Your videos etc.
9.You further understand that all assured rewards pertaining to the Campaign are non-transferable and cannot be licensed or assigned to any other individual and/or cannot be claimed/enjoyed/sought by anyone else other than the winners of the Campaign declared by PUMA INDIA.
10.You understand and agree that each assured reward will be awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). There are no cash or other prize alternatives available in whole or in part. You further understand that in the event You do not respond back to any communications sent in relation to the Campaign within the time period communicated, You shall not be eligible to be declared winner of the said Campaign. You agree PUMA IDNIA decision on the winner shall be considered as final.
11.By participating in the Campaign, You authorize PUMA INDIA to re-post Your posts that You have uploaded on X through Your own handle pertaining to the Campaign and PUMA INDIA shall not be liable for the breach of any third party rights therein.
12.By participating in the Campaign, You hereby authorize PUMA INDIA to use Your Personal Information including but not limited to names, email ID, residential address, Your posts that You have uploaded on X through Your own handle pertaining to the Campaign, any such personal data for any marketing or promotional campaigns. Such use of the data by PUMA INDIA shall in no case be termed as invasion of privacy and personal rights and You further indemnify PUMA INDIA from all such claims and/or loss.
13.You understand that Your participation in this Campaign shall be limited to only this Campaign only and in no manner shall entitle You to be eligible for any other contest that may be initiated by PUMA INDIA in the future. Further, You shall comply/abide with the rules/instructions given by PUMA INDIA and You agree and undertake that any non-adherence to the same shall result in disqualification. Any lack of cooperation from Your end shall entitle PUMA INDIA to forfeit the rewards in its entirety or pass on the said reward to another Participant at the sole discretion of PUMA INDIA.
14.You understand that in the event of any inconsistency between these terms and conditions and any advertising, promotional, publicity and other materials relating to or in connection with this promotion, these terms and conditions shall prevail.
15.You agree and understand that PUMA INDIA has no control over and is not responsible if for any reason/s whatsoever, if the said rewards cannot be availed/redeemed by You for any reason whatsoever and in no event shall PUMA INDIA be liable for any losses or any incidental or consequential damages whatsoever that You may incur for the same.
16.By participating into this Campaign, You hereby agree that PUMA INDIA shall not be liable for any injury, loss, or damage of any kind resulting from Your participation in this Campaign or from the acceptance or use/misuse of said rewards. This includes, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. By participating in this Campaign, You accept all risk and consequences of entry and participation in this Campaign, and agree to release and hold PUMA INDIA its officers, directors, affiliates, employees, contractors, subsidiaries, agents and partners harmless from any and all consequences, liability, losses, damages (including without limitation, consequential, punitive, incidental, special or increased damages and those related to personal injury, death or damage to property) and costs and expenses, of any kind, under any legal theory, arising from or related to this Campaign, including but limited to the entry and participation in this Campaign, the acceptance and/or use (or misuse) of any prize, printing errors, any claims based upon rights of publicity and invasion of privacy.
17.You shall indemnify PUMA INDIA, its officers, directors, affiliates, contractors, subsidiaries, agents, employees and partners from and against all claims or suits and any damages or costs (including reasonable attorneys’ fees) arising from or relating to Your violation/ breach of the rules and regulations of any authorities, or inaccuracy of any warrantees or representations made relating to this Campaign. You agree and undertake that PUMA INDIA assumes no responsibility for errors which may occur in the transmission of Your entry. PUMA INDIA is not responsible for any fraud or misconduct on Your part. Should You engage in fraud or misconduct of any nature, including but not limited to a violation of the official rules of the Campaign, You understand and agree that You will be disqualified from participating in the Campaign immediately.
18.You understand and agree that PUMA INDIA reserves the right to terminate, modify or amend the Campaign at any time if the fairness, integrity, and or proper administration of the Campaign is jeopardized. You further agree and undertake that in no event, shall PUMA INDIA be liable to You for any lost profits, or for any special, incidental, consequential or other indirect damages arising out of or in connection with this Campaign.
19.You understand that WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH REWARDS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND CAMPAIGN ENTITIES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSES AND/OR NON-INFRINGEMENT.
20.PUMA INDIA accepts no responsibility for any incomplete, incorrectly submitted, illegible, corrupted or misdirected entries whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. To the fullest extent permitted by law, PUMA INDIA hereby excludes all warranties, representations, covenants and liability (whether express or implied) regarding the Campaign. You shall be solely responsible/liable to comply and abide by the rules, regulations, policies and obligations as mandated the relevant authorities and/ or by any social media channel.
21.None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between PUMA INDIA and Yourself and You shall have no authority to bind PUMA INDIA in any manner whatsoever.
22.All rights, title and interest including but not limited to the Intellectual Property Rights in the promotional material(s) and any/all registrations received shall vest solely and exclusively with PUMA INDIA at all times and PUMA INDIA or any other of the PUMA Group Companies, affiliates shall be entitled to use the articles, database, material of the entries received or any information in any media for future promotional, marketing and publicity purpose without any further reference or payment or compensation to I as a participant of the said Campaign. These Terms & Conditions does not intend to transfer any intellectual property right of PUMA INDIA and PUMA INDIA shall continue to be the sole owner of all its such intellectual property
23.You shall be solely responsible for any consequences which may arise due to any kind of infringement of copyrights or any kind of intellectual property rights belonging to any third person, entity and/ authorities etc., and also undertake to indemnify PUMA INDIA and its officers, directors, employees, etc. on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis.
24.You understand that Your mere participation should not be perceived as any commitment on the part of PUMA INDIA to select a You as the winner. Nothing herein amounts to a commitment by PUMA INDIA to conduct further, similar or other campaigns/ competitions in future.
25.You understand that PUMA INDIA reserves its rights to cancel, amend, suspend, withdraw, and/or reset the Campaign and the terms and conditions at any time without any prior notice.
26.You understand that Your participation in this Campaign is as per the designated format and will constitute Your acceptance of these Terms and Conditions. Such acceptance of Yours shall be without any limitation.
27.You hereby consent to the exclusive jurisdiction and venue of courts in Bangalore, India in all disputes arising out of or relating to the Campaign or any of the Terms and Conditions set out therein.
Terms & Conditions for Leaderboard
The leaderboard on PUMA.com shall at all times show only the top 3 participants basis the earliest date and time of posting and this decision of PUMA INDIA’s shall be absolute
The leaderboard shall refreshed at a pre-determined frequency, decided solely at the discretion of PUMA INDIA
The Participant shall only qualify for the leaderboard if the PUMA Dive % is higher than 10%
It is hereby clarified that in the event during the Campaign, if any image (which has been captured by You/ user for the purpose of the said Campaign) has received100% score, a match of 100% for the the same image/ entry shall not be considered and PUMA's decision on this shall be absolute and final
Offline Events & Activations
If you choose to participate in the offline #PUMADive events, you consent to hereby do so voluntarily and shall not hold PUMA INDIA liable to You for any reason manner whatsoever;
any content being created with you and published by PUMA INDIA on their channels, including but not limited to the website, app, and social media and you hereby consent to provide your images/ videos for the same
PUMA India shall not be responsible in case of any injuries that may arise from participation in the offline activities. As You confirm to be taking part in the offline events voluntarily
